ACNC Funded for Anticipated Litigation

The national charity regulator is set to receive $1 million in funding to meet the costs of anticipated litigation.
It was revealed in the federal budget on Tuesday that the government will provide $1 million in 2018-19 to the Australian Charities and Not-for-profits Commission “to meet the costs of anticipated litigation” as the ACNC pursues its role in regulating charities and charity registration.
ACNC Commissioner Dr Gary Johns told Pro Bono News the funding followed a request to the government to ensure the regulator was appropriately resourced.
“Ahead of the 2018 federal budget, the ACNC informed the government that we were not appropriately resourced for litigation should issues arise in the course of charity regulation,” Johns said.
“In [the] federal budget announcement, the government allocated an additional $1 million to the ACNC for litigation for the 2018-19 financial year.
“The ACNC is now resourced should it be necessary to clarify any questions of charity law or regulation through appeals.”
